Insolvency & Recovery – Asset Realisation

Hicks Day Jones & Westlake offer a comprehensive range of asset realisation and associated case management services to leading Insolvency Practitioners, both local and national, solicitors, Trustees in Bankruptcy, Liquidators, Administrators and Receivers. Whilst the principal centre of activity for this aspect of the practice is South, Mid and West Wales, Bristol and West Country together with Gloucestershire and Herefordshire, recent instructions include residential properties in London to holiday apartments in Bulgaria.

The following example cases illustrate scope and nature of activity:

Wholesale and retail tile & roofing material supplier – West and North Wales

Full valuation exercise for proposed Liquidator and purposes of creditor’s meeting. Upon subsequent appointment of Liquidator, accepting ongoing instructions in relation to realisation of all company assets including significant quantity of stock in trade. Resolving all retention of title issues including dealing with supplier companies based in Turkey and Mainland Europe. Facilitating full clearance of all trading premises to satisfaction of Landlord. Administering all third party claims on behalf of Liquidator achieving gross realisations of £198,582.93.

Brick Manufacturer – Cardiff

Following dedicated marketing programme including press and internet agreement for sale of all production plant and equipment and stock with a total gross realisation of £208,000. A complete case management package was offered including negotiations with Landlord and site security and the settling of retention issues and finance claims.

Heavy Engineering Company – Gwent Valley

Valuation and realisation exercise on above for Company Liquidator and Debenture holder resulting in total gross realisation for plant and equipment of £378,000.

Overseas Property Developer and Sales, Company Headquarters – Bristol

Sale of freehold office building (joint agency) resulting in realisation of £1,100,000. Negotiating separate sale of chattels being office furniture at a figure in excess of £20,000. Offering complete management function including property over a period of two years.

Builders Merchants – Rhondda Valleys

Following formal report and valuation opinion for Liquidator upon appointment, undertaking dedicated marketing exercise of commercial motor vehicles, plant and stock in trade resulting in sales with a gross realisation of £104,000. A particular feature of this instruction was the resolution of a succession of supplier retention of title claims. To maximise the realisation a secured and structured conditional sale agreement was entered into.

Specialist Shop Fitting Company – Rogerstone, Newport

Acting on behalf of Joint Administrators in valuation and realisation of all company chattel assets and fleet vehicles. Undertaking all necessary negotiations with lease company as regards vehicles, agreeing consolidated settlement resulting in significant equity surplus accruing to Administration. Acting as keyholders for property and undertaking associated case management. Full clearance of premises.

Demountable Office Company – Head Office, Manchester

Acting on behalf of appointed Administrator, undertaking valuation exercise in respect of all company assets including hire book, intellectual property and intangible assets. Advising on lease and property matters. Providing advices to Administrator and their appointed solicitors as to sale and purchase agreement for certain chattel assets and hire book. Arranging clearance of main depot, Carrington, Manchester.
